Under these terms and conditions, we are providing an online platform for displaying and storing data relating to the animal sampling DNA (Data) that you collect, upload and provide participating laboratories access to for analysis purposes.  We are not acting as an agent for any party.  Participating laboratories are independent operators and we are not responsible for, nor do we verify, any results or analysis supplied to you by a participating laboratory.

While we take care to ensure that the content of this website is accurate and up to date, we give no warranty (express or implied) as to the accuracy, completeness or non-infringement of any content, including any Data uploaded through the website.

 

Intellectual Property

The content of this website (including all information, material, text, graphics and design) is the copyright of SNPshot Technologies Limited and/or its licensors. The brands appearing on this website are our trademarks or their respective owners. All intellectual property rights are reserved. 

Nothing in these terms and conditions constitutes a transfer or licence of any of our intellectual property rights, including any intellectual property rights that we have in and to the platform, goods, systems, information, or other content that is referenced, displayed or available through the website.

You agree not to adapt, alter or create a derivative work from any intellectual property, source code, or other content available through the website except for your own internal, non-commercial use.

All Data remains the property of the person who uploaded it and we obtain no right to or interest in the Data except as expressly set out in these terms and conditions.

 

Your use of the website

To upload Data through the website, you must register an account. You are responsible for maintaining the security of your account and any Data accessible through it. 

You acknowledge that the participating laboratory that you have selected to undertake analysis of your animal sampling DNA will have access to your Data through the website.   We accept no responsibility for the actions of any participating laboratory including their access to or use of the Data.

We have no obligation to retain Data and we may, without liability to you, delete Data after a reasonable period of time following inactivity of your account.

You acknowledge and accept that we may access and use Data, solely in an aggregated and anonymised form, to gain insights and undertake market analysis for internal business and commercial purposes.

When accessing or using this website, you agree that you will at all times comply with all applicable laws, and will not:

  • (a) reproduce, adapt, copy, distribute or incorporate in any other work, in whole or in part, any content from this website, including any trade mark appearing on the website, without our express written permission;
  • (b) create a link to the website (or any part of the website) from any other website, without our prior written consent.
  • (c) use the website in any way that may bring us into disrepute, or for any activity that is inappropriate; or
  • (d) use the website for any illegal activity, or for any activity that would cause us to breach any law;

 

Modifications and Availability

We may change this website and the information on it at any time without notice. We may from time to time introduce or offer new functionality, features or other goods or services that may be subject to specific terms and conditions in addition to these terms and conditions. 

The website is provided on an “as is” and “as available” basis and your use of the website (including storage of and access to Data) is at your own risk. The website may not be continuously available or error free and you acknowledge and agree that we shall not be liable to you or to any third party for any unavailability, modification, suspension or discontinuance of the website.

Any amendment will be effective from the date the amended terms and conditions are posted on this website.  Any use of, or access to, this website after the effective date of an amendment will constitute deemed acceptance of those changes.  If you do not accept any amendment, you must not access or use this website.

To the maximum extent permitted by law, we disclaim and exclude all implied conditions or warranties in relation to the website and storage of Data.

We do not warrant that the website will be compatible with your equipment, secure, or that the Data will be free from errors, loss, destruction, interruption or corruption.

We do not make any warranty regarding the quality or standard, or the abilities, skill or experience of any participating laboratory.

 

Limitation of Liability

To the maximum extent permitted by law, we exclude all liability and responsibility to any person for any direct, indirect or consequential loss or damage (in contract, tort, equity or otherwise) that may result from:

  • the use of this website or from the access to, use of, or reliance on any information provided on or made available through this website;
     
  • the loss, corruption, unavailability, deletion, or unauthorised access to or use of any Data; and/or
     
  • spyware, viruses, worms, trojan horses or other items of a destructive nature that may be transmitted to your computer by use of the website.

Subject to the exclusions of liability above, and to the extent permitted by law, our maximum liability to you in connection with any claims arising from your access to or use of our website will not exceed $500.

You agree that we are not responsible for, nor do we endorse, any third-party websites or content which you access in the course of using this website.

Any sites linked to our website by hyperlinks are not under our control. We are not responsible for, and make no representations or warranties concerning, any linked sites.

Should a dispute arise between yourself and any third party due to use of the website, we may assist you to resolve the dispute but will not be responsible for any loss or damage you suffer as a result of that use.

You may not assign or transfer any of your rights under these terms and conditions.  We may assign or transfer any or all of our rights or obligations under these terms and conditions without the consent of any person. 

If any part of these terms and conditions is, or becomes, legally invalid or unenforceable, the remainder of these terms and conditions subsist and remain in force.

If we do not exercise or enforce any rights available to us under these terms and conditions that does not constitute a waiver of those rights.

These terms and conditions are governed by the laws of New Zealand and the New Zealand courts have exclusive jurisdiction.
